This Privacy Policy outlines the obligations of Daylight Transport, LLC., a California company (“Daylight Transport”) regarding the collection, use, and disclosure of information collected from you via the Daylight Transport website located at https://www.dylt.com (the “Daylight Transport Site”) and via Daylight Transport’s mobile applications, including the APEX Dispatch mobile application (each, an “App,” and together with the Daylight Transport Site, the “Services”). By accessing the Daylight Transport Site or using a Daylight Transport App, you consent to the collection and use of your information in accordance with the terms of this Privacy Policy. If you do not want your information to be collected and used in the manner described in this Privacy Policy, please do not access the Daylight Transport Site or use an App.

The Daylight Transport Site is hosted in the United States and is intended for and directed to users in the United States. If you are a user accessing the Daylight Transport Site from the European Union, Asia, or any other region with laws or regulations governing personal data collection, use, and disclosure, that differ from United States laws, please be advised that through your continued use of the Daylight Transport Site, which is governed by U.S. law, this Privacy Policy, and the Daylight Transport Website Terms of Use Agreement, you are transferring your personal information to the United States and you consent to this transfer.

   Information Collected.Daylight Transport may sometimes collect personal information from you on the Daylight Transport Site. The personal information may include your name, address, email address, and other contact information. In addition, Daylight Transport may collect anonymous information, including a user’s IP address, browser type, and the date and time a user accesses the Daylight Transport Site. Daylight Transport uses this anonymous information for system administration purposes to enhance the operation of the Daylight Transport Site and make it more useful to users. Information collected through an App, including location and device information, is described in Section 12 (Mobile Applications and Location Data).

   Collection of Other Information.Daylight Transport may, from time to time, collect other information from you (for instance, when Daylight Transport makes special offers, holds promotions, or conducts surveys). Information collected by these means is used internally for purposes such as marketing, customer administration, technical administration of the Daylight Transport Site, or to contact you. Daylight Transport does not share this information with outside parties except as indicated in the “Information Sharing” section below.

   Children’s Privacy Policy.Daylight Transport does not knowingly collect the personally identifiable information of children under the age of 13. Because Daylight Transport is committed to protecting children’s privacy online, use of the Daylight Transport Site by children under the age of 13 is prohibited.

   Cookies.Daylight Transport uses cookies. A cookie is a small amount of data placed on your computer’s hard drive by Daylight Transport that can transmit your information to Daylight Transport. Daylight Transport uses both session ID cookies and persistent cookies. A session cookie terminates automatically after you close your browser. A persistent cookie remains on your hard drive, but you can remove it by following your browser’s instructions for deleting cookies. You can set your browser to disable cookies, but this may prevent you from enjoying all of the features of the Daylight Transport Site. Daylight Transport uses cookies to deliver content tailored to your interests, streamline the login process, and collect anonymous user data in aggregate. The cookies make your use of the Daylight Transport Site easier, make the Daylight Transport Site operate more smoothly, and help Daylight Transport to maintain the security of the Daylight Transport Site. Some outside parties may use cookies with the Daylight Transport Site. Daylight Transport has no access to or control over these cookies.

   Information Sharing.Except as set forth in this Privacy Policy, Daylight Transport does not disclose or sell your personally identifiable information to outside parties. Some features of the Daylight Transport Site are made possible through Daylight Transport’s partnerships with outside parties. As part of your use of these features, you agree to permit Daylight Transport to share your personal information with these parties. Daylight Transport takes great care in selecting business partners with whom it shares your information. However, Daylight Transport is not a guarantor of outside parties’ practices regarding your information. Users of the Daylight Transport Site permit the sharing of their personal information at their own risk and shall not hold Daylight Transport responsible for acts or omissions of outside parties. Daylight Transport will disclose your information when we believe in good faith that it is legally required, such as pursuant to a warrant, subpoena, or court order, or to protect our rights and property. Daylight Transport will disclose your information when appropriate to comply with the Digital Millennium Copyright Act or other laws and regulations. If Daylight Transport is acquired by or merged into another company, all information collected will be transferred to the acquiring company as one of Daylight Transport’s assets and will be governed by the acquiring company’s privacy policy, if any.

The personally identifiable information you provide is stored on third-party-owned computer servers that are located in a controlled, secure environment and are protected from unauthorized access. Daylight Transport partners only with companies that will responsibly handle your personal information; however, Daylight Transport is not a guarantor of such companies’ security practices.

   Links.The Daylight Transport Site contains links to other websites. Daylight Transport is not responsible for the privacy practices or the content of such other websites.

   Correction or Updating Personal Information.You may use the contact information provided below in Section 9 to request a change in or update of your personal information (such as an address correction), or to have your personal information removed from Daylight Transport’s database. Daylight Transport will correct, update, or delete your personal data upon your request.

    Mobile Applications and Location Data.Daylight Transport offers mobile applications (each, an “App”), including the APEX Dispatch mobile application, that support pickup and delivery operations for company drivers and authorized non-company drivers such as contractors and owner-operators. This Section supplements the disclosures above and applies to information Daylight Transport collects through an App.

    Location information.To provide dispatch, route optimization, and turn-by-turn navigation, an App collects precise location information, including GPS-based geolocation, from your device. With your permission, an App accesses your location while you are using it, and, where enabled, while it is running in the background, so that navigation, routing, and shipment status updates continue during active dispatch. An App requests your permission to access your location, and you can enable or disable location access at any time in your device settings. Disabling location will prevent routing and navigation features from working.

    How location information is used.Daylight Transport uses location information to assign and manage pickups and deliveries; calculate and display routes and turn-by-turn directions; estimate arrival times and monitor service performance; confirm pickup and delivery events; and support operational, safety, and dispatch communications.

    Other information collected by an App.An App may also collect device and usage information, such as a device identifier, device and operating system type, App version, and diagnostic or performance data, used to operate, secure, and improve the App.

    Service providers and mapping partners.Daylight Transport uses third-party mapping and navigation services to provide routing and directions. To deliver these features, location and related information may be processed by these providers under their own privacy terms. Routing and navigation features are provided in part by HERE.com, and your use of those features is subject to the HERE.com policy (HERE Technologies Privacy Policy). Daylight Transport does not sell your location information.

    Retention.Daylight Transport retains location information only as long as needed for the operational and recordkeeping purposes described above and as required by applicable law, after which it is deleted or de-identified.

    Your choices.You can control location access through your device’s permission settings. You may also contact Daylight Transport using the information in Section 10 to request access to, or deletion of, the information collected through a Daylight Transport App.
